In an interview Lucy Hale(Aria) sinabi they were doing it completely different from the books so he might not be.

I think he's hurt,but that's only because I don't want to believe that he's dead.I refuse to believe that until I have further proof.

Actually Toby isn't dead. In the previews and the shows they mention that Toby was spotted at a gas station and in the prebiyu for susunod weeks episode Toby appears in Emily's car. So no he isn't dead.

No he's not dead in the book maybe,but the ipakita no they staged his death so Spencer would see and become crazy and have to go to Radley where she joins the A team and meets up with Toby who was also on the A team to protect Spencer from A so Toby is not dead!
